We have the same situation on Delphine - a fixed eye for the spinnaker that's too high for the whisker pole. However, we use the whisker pole in the spinnaker eye and, even though the pole slopes down from the mast, it's still effective at holding the jib out. The shape of the foresail would undoubtedly be improved with a lower eye, but it's still more effective than not using the whisker pole at all...
